Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Precision Vision Institute ("Practice," "we," "us," or "our") governing your access to and use of our website, digital scheduling features, contact forms, and online service tools (collectively, the "Site").

By accessing or using the Site, you confirm that you have read, understood, and agreed to be bound by these Terms and our Website Privacy Policy. If you do not agree with these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.

Emergency & Clinical Medical Disclaimer

A. Not Medical Advice

The information, materials, graphics, text, frame try-on modules, and self-assessment content available on this Site are provided strictly for general educational and informational purposes. Nothing on this Site constitutes formal medical advice, diagnosis, optical prescription, or clinical treatment plans.

B. No Doctor-Patient Relationship Created

Navigating this Site, submitting an online contact request, or transmitting an appointment request does not create a formal doctor-patient relationship between you and Precision Vision Institute or any of its licensed optometrists or ophthalmologists. A doctor-patient relationship is established only upon completing an in-person or formal telehealth clinical consultation with a provider.

C. Emergency Warning

Do not use this Site or our online forms for medical emergencies. If you are experiencing a medical emergency, acute eye trauma, sudden loss of vision, severe eye pain, or flashing lights or floaters, call 911 immediately or proceed to the nearest emergency medical facility.

Intellectual Property Rights

Unless otherwise indicated, the Site, including its source code, databases, website functionality, software applications, custom appointment widgets, visual design, text, photographs, and graphics, as well as the trademarks and logos contained therein, are owned or controlled by Precision Vision Institute or licensed to us, and are protected by United States and international copyright, trademark, and unfair competition laws.

You are granted a limited, revocable, non-transferable license to access and use the Site solely for your personal, non-commercial informational use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Content without our prior written consent.

User Conduct & Acceptable Use

When utilizing our Site, contact mechanisms, and booking portals, you agree not to:

  • Submit false, misleading, fraudulent, or inaccurate personal or medical information.
  • Attempt to bypass, disable, or tamper with security protocols, access controls, or bot-mitigation mechanisms protecting the Site or connected patient portals (for example, EyeCloud).
  • Introduce viruses, malware, trojan horses, worms, logic bombs, or other malicious code designed to interrupt or compromise site performance.
  • Use automated tools, scrapers, bots, or spiders to extract data from the Site without authorization.
  • Interfere with or disrupt the network connections or servers hosting the Site.

Third-Party Web Links and Software Integrations

The Site may contain links to third-party platforms, external informational resources, frames try-on software, or integrated healthcare tools, including our EyeCloud scheduling system. We do not control, endorse, or accept responsibility for the content, privacy policies, uptime, or operational practices of any third-party websites or services. Accessing third-party tools is done entirely at your own risk.

Limitation of Liability and Disclaimer of Warranties

A. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site and all content, services, and features are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Precision Vision Institute disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses.

B. Limitation of Liability

To the fullest extent permitted by applicable state law, in no event shall Precision Vision Institute, its directors, employees, physicians, affiliates, agents, or third-party software providers be liable for any direct, indirect, incidental, consequential, special, or punitive damages—including lost profits, data loss, or business interruption—arising out of or in connection with your use of, or inability to use, this Site or its contents.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply, and you may have additional statutory rights under your state's laws.

You agree to defend, indemnify, and hold harmless Precision Vision Institute, its officers, directors, licensed providers, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any third-party intellectual property or privacy rights.

Governing Law and Severability

These Terms shall be governed by and construed in accordance with the laws of the State in which Precision Vision Institute maintains its primary physical clinical facility, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms or Site usage shall be brought exclusively in the state or federal courts serving our local clinical county.

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

Modifications to Terms

We reserve the right to revise, modify, or update these Terms of Service at any time without prior notice. The updated version will be posted directly to this page with a revised Effective Date. Continued use of the Site following posted changes constitutes full legal acceptance of the modified Terms.
